1. Acceptance of Terms
These Terms of Service ("Terms") are a legal agreement between you and TunnelQuiz. By creating an account, buying Credits, taking an assessment, or otherwise using the Platform, you accept these Terms and agree to be bound by them.
If you are accepting these Terms on behalf of an organization, you promise that you have the authority to bind that organization, and "you" in these Terms includes both you personally and the organization you represent.
If you do not agree to any part of these Terms, you must not use the Platform.
These Terms apply together with our Privacy Policy (which describes how we handle your Personal Information) and our Data Processing Agreement (which applies where an Organization uses TunnelQuiz to process Candidate data). If there is any conflict, these Terms prevail unless another document is specifically named to control on that point.
2. Definitions
- "TunnelQuiz," "we," "us," "our", the company operating the TunnelQuiz platform, incorporated under the laws of India, with its registered office at Surat, Gujarat, India.
- "Platform", the TunnelQuiz software, website, mobile experiences, dashboards, APIs, integrations, and any related service we make available.
- "Organization", the company or entity that has an account with TunnelQuiz to create and run assessments.
- "Organization User", an individual an Organization invites into its account (Admin, Editor, Recruiter, or Viewer, or any other role we introduce).
- "Candidate", an individual who takes an assessment through the Platform, typically at the invitation of an Organization.
- "You", depending on context, an Organization, an Organization User, a Candidate, or a website visitor.
- "Credit", a unit of usage on the Platform, purchased by an Organization and spent when the Organization invites Candidates or enables paid features on an assessment. Credits are not currency, have no cash value, and are described in Section 7.
- "Assessment", a multiple-choice test that an Organization creates and delivers through the Platform.
- "Assessment Data", the questions, answers, scores, timing data, and proctoring signals generated when a Candidate takes an Assessment.
- "Content", any information, question text, media, or material uploaded to or generated on the Platform.
3. Eligibility
To use TunnelQuiz you must:
- Be at least 18 years old, or the legal age of majority in your jurisdiction, whichever is higher.
- Be capable of forming a legally binding contract under the law of your jurisdiction.
- Not be barred from using the Platform under the laws of your country, or the country where the Platform is operated.
- Not be on any government sanctions list, or acting on behalf of any sanctioned party.
Organizations must be validly incorporated (or, for individuals acting in a professional capacity, be lawfully authorized to purchase business services).
TunnelQuiz is not intended for children under 16. Organizations must not invite Candidates under the age of 16 unless local law permits it and the necessary consents are in place.
4. Account Registration
To use most parts of the Platform, you must create an account.
When registering, you agree to:
- Give accurate, current, and complete information about yourself and (where applicable) the Organization
- Keep that information up to date
- Keep your login credentials confidential and not share them with anyone
- Notify us immediately at [email protected] if you suspect your account has been accessed without your permission
- Be responsible for all activity that happens under your account, whether authorized by you or not
We may refuse a registration, or suspend or terminate an account, if we reasonably believe the registration is fraudulent, misleading, or in breach of these Terms.
5. Organization Accounts
An Organization account gives one or more Organization Users access to the Platform on behalf of an Organization.
- The person who first creates the Organization account becomes the Organization Admin. The Admin can invite other Organization Users, assign roles, buy Credits, and delete the account.
- The Organization is responsible for the actions of everyone it invites into its account.
- Roles inside an Organization account are: Admin, Editor, Recruiter, and Viewer. Each role has different permissions. The Organization Admin decides who has which role.
- If an Organization User leaves the Organization, the Admin is responsible for removing that person's access.
- TunnelQuiz will treat instructions from Organization Users as instructions from the Organization, based on their assigned role.
6. Candidate Accounts
Candidates do not need to sign up for a permanent TunnelQuiz account. When an Organization invites a Candidate to take an Assessment, the Candidate is given a link and (unless the Organization has disabled it) verifies their identity with an OTP sent to their email or phone.
- A Candidate's Assessment record belongs to the Organization that created the Assessment.
- Candidates should read the information shown on the Assessment landing page carefully before they consent to start.
- Candidates who believe their Personal Information is being misused should first contact the Organization that invited them, then contact us if needed (see the Privacy Policy).
7. Credit-Based Pricing Model
TunnelQuiz is a paid service. Organizations pay for the Platform by purchasing Credits and spending them on Platform activity. Credits are the sole billing unit of the Platform, and they replace per-seat pricing.
7.1 Purchasing Credits
- Organizations can purchase Credits directly through the Platform, or through an invoice arrangement with our sales team for larger volumes.
- Purchased Credits appear in the Organization's account balance immediately upon successful payment (or upon receipt of payment, for invoice arrangements).
- Prices for Credits are shown on the pricing page and may change from time to time; purchases made at the previous price are honored at that price.
- Applicable taxes (GST, VAT, sales tax) will be added at checkout where required.
7.2 Credit Usage
Credits are spent when the Organization takes certain actions on the Platform. Typical actions include:
- Sending an Assessment invitation to a Candidate
- Adding certain proctoring options (for example, webcam snapshots or screen capture) to an Assessment
- Enabling optional features on an Assessment (for example, identity verification)
The Credit Rate Card is published on the pricing page and describes the exact number of Credits each action consumes. The Rate Card may change from time to time; changes take effect from the date they are posted, and Credits already in the Organization's balance are consumed at the rates in effect on the day of consumption.
Organizations can see the balance of Credits available at any time from the dashboard.
7.3 Credit Expiration
Credits purchased by an Organization do not expire while the Organization's account is in good standing. This means Credits remain in the account for as long as the account exists and is not suspended or terminated for cause.
If an Organization account is terminated (by the Organization itself, or by TunnelQuiz for cause under Section 22), any unused Credits will be treated according to the reason for termination:
- Termination by the Organization for convenience, unused Credits are forfeited unless a refund is granted under Section 7.4.
- Termination by TunnelQuiz for cause, unused Credits are forfeited.
- Termination by TunnelQuiz for our own convenience, the Organization will be offered a pro-rata refund of the fair value of unused Credits.
7.4 Refund Policy
- Automatic refunds on incomplete Assessments. If a Candidate does not complete an Assessment (for example, they never open the link, or they abandon before submission), the Credit spent on that invitation is automatically refunded to the Organization's balance. This happens without a support request.
- New-account refunds. Within 14 days of an Organization's first Credit purchase, the Organization may request a full refund of any unused Credits from that purchase by writing to [email protected]. This right applies to the first purchase only.
- All other refunds. After the first 14 days, purchased Credits are non-refundable except where required by applicable law. If you believe you were overcharged, contact [email protected] and we will investigate.
- No cash conversion. Credits have no cash value and cannot be transferred to another Organization or exchanged for money outside of the refund windows above.
7.5 Free Credits
TunnelQuiz may from time to time offer free Credits (for example, a free trial or promotional grant). Free Credits:
- Are not eligible for refund and cannot be converted to cash
- May be subject to their own expiration terms, which will be clearly stated at the time they are offered
- Are consumed first, before any purchased Credits, unless we state otherwise
8. Subscription Terms
The default TunnelQuiz model is credit-based rather than subscription-based. However, we may offer optional subscription add-ons, for example, a dedicated support plan or an enterprise support tier. If you agree to a subscription add-on, the specific commercial terms (price, renewal, cancellation) will be set out in an order form or the checkout screen at the point of purchase.
Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You may cancel a subscription at any time from your account settings; cancellation takes effect at the end of the current billing period.
9. Acceptable Use Policy
You agree to use TunnelQuiz only for lawful purposes and only in a way that respects other users, Candidates, and the general public.
You will not use the Platform to:
- Break any law, regulation, or third-party right
- Discriminate against Candidates on the basis of any protected characteristic under applicable law
- Harass, threaten, or intimidate any person
- Send unsolicited commercial messages ("spam") through the Platform
- Harm the reputation of TunnelQuiz or any user
- Use the Platform to build a competing service
We reserve the right to investigate suspected violations of this Acceptable Use Policy and to suspend or terminate access as described in Section 22.
10. Prohibited Activities
In addition to the general Acceptable Use rules in Section 9, you specifically agree not to:
- Reverse-engineer, decompile, or attempt to extract source code from the Platform
- Copy, modify, or distribute any part of the Platform for anything other than internal use permitted by these Terms
- Circumvent, disable, or otherwise interfere with security or access controls
- Use the Platform to run any assessment that is unlawful in the jurisdiction of the Candidate or the Organization
- Attempt to gain unauthorized access to another Organization's account or Assessment Data
- Introduce viruses, worms, or any other malicious code
- Overload, flood, or otherwise degrade the availability of the Platform
- Scrape, harvest, or crawl the Platform except with our prior written consent
- Use the Platform to test any individual without a legitimate hiring, education, certification, or training purpose
11. Assessment Rules
Assessments are the core of the Platform. To keep them fair for Candidates and useful for Organizations, both sides must follow certain rules.
- Content ownership. Question text, question banks, and assessment structures uploaded to the Platform belong to the Organization that uploaded them. TunnelQuiz does not claim ownership of an Organization's questions.
- Content standards. Questions must not include discriminatory, defamatory, or unlawful material, and must not include content protected by copyright unless the Organization has permission to use it.
- Transparency to Candidates. Before an Assessment starts, the Platform will show the Candidate what will happen, the number of questions, the time limit, whether the webcam or screen will be recorded, and what proctoring signals will be active.
- One Candidate per invitation. An Assessment invitation is for one Candidate. Organizations must not share invitation links publicly except where they have deliberately created a public link with no OTP.
- Retake rules. The Organization sets the retake policy per Assessment. Once a Candidate has submitted, they cannot retake the Assessment unless the Organization allows it.
12. AI Proctoring
Proctoring is an optional set of features that Organizations can enable per Assessment. Because proctoring involves collecting information about how the Candidate takes the test, both Organizations and Candidates must understand how it works.
12.1 Proctoring signals TunnelQuiz can collect (only when enabled)
- Full-screen exits
- Tab or window switching
- Copy, cut, and paste attempts
- Developer tools opening
- Multiple monitors connected
- Screen-sharing applications detected on the device
- Loss of window focus
- Right-click / context menu use
- Webcam snapshots (still images)
- Screen captures (periodic screenshots of the shared screen)
- Ambient audio events (loud noises)
12.2 Proctoring signals TunnelQuiz does NOT collect
TunnelQuiz does not perform:
- Biometric facial recognition
- Continuous video recording of the Candidate
- Eye-gaze tracking
- Keystroke logging beyond aggregate event counts
- Location tracking beyond an approximate country/region from the IP address
12.3 How proctoring signals are used
Proctoring signals are shown to the Organization in the dashboard. The Organization can review them and decide whether they matter. TunnelQuiz does not automatically reject a Candidate on the basis of a proctoring signal, decisions are always made by a human at the Organization.
12.4 Consent
Candidates must be told, in the Assessment landing page, which proctoring signals will be active for a given Assessment. Candidates consent to those signals by choosing to start the Assessment. Candidates who do not consent may refuse to start; no Assessment data will be collected for a Candidate who does not start.
12.5 Fair use of proctoring
Organizations agree to enable only the proctoring signals that are reasonable for the role and jurisdiction. In particular, Organizations should not enable webcam or screen capture for informal, low-stakes assessments where doing so would be disproportionate to the risk.
13. Candidate Responsibilities
If you take an Assessment through TunnelQuiz, you agree to:
- Provide accurate identity information when asked
- Take the Assessment yourself and not allow anyone else to take it on your behalf
- Follow the on-screen rules of the Assessment
- Not attempt to cheat, whether by tab switching, copy-paste, screen sharing, using another device, using another person, or any other method
- Not attempt to attack, reverse engineer, or otherwise disrupt the Platform
- Respect any confidentiality expectation the Organization has communicated about the Assessment content
Candidates who breach these responsibilities may have their Assessment invalidated by the Organization and, in serious cases, may be reported to the Organization and to law enforcement.
14. Organization Responsibilities
Organizations that use TunnelQuiz agree to:
- Use the Platform lawfully, fairly, and only for legitimate hiring, education, certification, or training purposes
- Give Candidates accurate information about how their data will be used
- Enable proctoring signals only to the level reasonable for the Assessment
- Manage Organization User access, invite, remove, and role appropriately
- Respond to Candidate rights requests as the Data Controller of Candidate Personal Information
- Comply with local labor, education, and data-protection laws in the jurisdiction of every Candidate they invite
- Not use TunnelQuiz to discriminate against Candidates on the basis of any protected characteristic under applicable law
- Pay all applicable fees for Credits and any subscription add-ons on time
Where an Organization uses TunnelQuiz to process Candidate Personal Information, the Data Processing Agreement (available at available on request or on request) governs the specific data-processing terms. In the event of any inconsistency between these Terms and the DPA in respect of Candidate Personal Information, the DPA prevails.
15. Intellectual Property
15.1 Our intellectual property
The Platform, including the software, the website, the design, the user interface, the TunnelQuiz name, the logo, and every improvement we make, belongs to TunnelQuiz or its licensors. All rights are reserved. Nothing in these Terms transfers our intellectual property to you.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for the purposes described in these Terms. That license ends when your right to use the Platform ends.
15.2 Your intellectual property
You keep every intellectual-property right you have in any Content you upload to the Platform (question banks, brand assets, marketing copy, and so on). You grant us a limited license to store, transmit, display, and process that Content only as needed to operate the Platform for you.
15.3 Feedback
If you send us suggestions, improvements, or feedback about the Platform, we may use those ideas without any obligation to you. You will not receive compensation or credit for feedback unless we agree otherwise in writing.
16. User Content
"User Content" means any Content you upload to, submit to, or generate on the Platform, including questions, answers, media, notes, comments, and communications.
You are responsible for your User Content. By submitting User Content you promise that:
- You own it, or you have the legal right to submit it
- It does not violate any third party's intellectual property, privacy, or other rights
- It is not defamatory, discriminatory, or otherwise unlawful
- It is not misleading or deceptive
We may remove User Content that we reasonably believe violates these promises or these Terms. We are not obliged to review, moderate, or endorse User Content, and we make no warranty about User Content submitted by others.
17. AI-Generated Content
The Platform uses automated systems and machine-learning models to help score Assessments and to generate analytics such as distractor analysis and question insights. Any output from these automated systems ("AI-Generated Content") is provided for the Organization's information only and is not a guarantee of any outcome.
- AI-Generated Content is a support tool for human decision-makers, not a replacement for their judgment.
- We do not warrant that AI-Generated Content is free of errors.
- Organizations must review AI-Generated Content before relying on it for any material decision, including hiring, promotion, or certification.
- Where AI-Generated Content is used in an Assessment context, the Organization is responsible for complying with any local laws on the use of AI in hiring or employment decisions.
18. Data Ownership
- Organization Data, data an Organization uploads or generates on the Platform (accounts, question banks, brand assets, Assessment results, and so on) belongs to the Organization.
- Candidate Data, Personal Information about a Candidate belongs to the Candidate. Where an Organization has collected Candidate Data through the Platform, the Organization holds it as Data Controller and TunnelQuiz processes it on the Organization's behalf.
- Platform Data, data we generate about how the Platform is used (aggregate analytics, system logs, usage patterns) belongs to TunnelQuiz.
- Anonymized Data, TunnelQuiz may retain and use anonymized data (data that cannot identify any individual) to improve the Platform indefinitely.
An Organization can export its Assessment Data at any time in CSV format from the dashboard. On request, we will also provide a full data export within a reasonable time.
19. Service Availability
We aim to keep the Platform available around the clock. However:
- We may perform planned maintenance and will try to schedule it outside typical business hours in the Organization's region, giving reasonable notice where possible.
- Unplanned downtime can happen, through hosting provider incidents, network issues, or events outside our control.
- Some features may be added, changed, or removed over time. We will give reasonable notice before making changes that would materially reduce the functionality you rely on.
Any specific uptime commitments, for example, in an Enterprise SLA, are set out in a separate written agreement.
Our public status page is available at available on request (subject to publication). We publish incidents there in near real time.
20. Third-Party Integrations
The Platform may connect with third-party services (for example, applicant tracking systems, email providers, SMS providers, payment processors, or single sign-on providers). Third-party services are provided by third parties and governed by their own terms and privacy policies.
- We do not warrant the availability or performance of any third-party service.
- If a third-party service stops working, or changes in a way that affects the Platform, we will do our best to adapt, but the risk is not ours.
- Any charges the third-party service imposes on you are your responsibility.
If you disable a third-party integration, some features that depend on it may stop working.
21. Payment Terms
- Currency. Prices are shown in the currency stated on the pricing page or the checkout screen (typically Indian Rupees, US Dollars, Euros, or another currency we support).
- Payment method. Credits can be paid for by card, bank transfer, or another method we make available. Card payments are handled by a third-party payment processor; card details are not stored on TunnelQuiz servers.
- Invoicing. For invoice-based purchases, payment is due within 30 days of the invoice date unless the invoice states otherwise.
- Taxes. Prices are exclusive of applicable taxes. GST, VAT, sales tax, or equivalent charges will be added at checkout as required.
- Late payment. If an invoice is not paid by the due date, we may (after giving you notice) suspend access to the Platform, and interest may accrue at the maximum rate permitted by applicable law.
- Reversed payments. If a payment is reversed (chargeback, insufficient funds, or otherwise), we may deduct the corresponding Credits from the Organization's balance and, if the balance is insufficient, suspend the account until the balance is restored.
Refunds for Credit purchases are governed by Section 7.4.
22. Suspension and Termination
22.1 Termination by you
- Organizations can terminate their account at any time from Settings. Termination takes effect at the end of the current billing period for any active subscription add-on. Unused Credits are governed by Section 7.3.
- Organization Users can leave an account by asking the Admin to remove them, or by deleting their user profile.
- Candidates cannot terminate an Assessment invitation, but they can decline to start the Assessment.
22.2 Termination by us for cause
We may suspend or terminate your access to the Platform, immediately and without refund, if:
- You materially breach these Terms and, where the breach is capable of cure, do not cure it within 14 days of receiving notice from us
- You breach Section 10 (Prohibited Activities)
- Your continued access poses a security or legal risk to us, another user, or a Candidate
- You fail to pay amounts owed after we have given you notice and a reasonable opportunity to pay
- We are required to do so by law or by a competent authority
Where possible we will give you notice before we suspend or terminate.
22.3 Termination by us for convenience
We may terminate an account for convenience by giving 30 days written notice. In this case, we will refund the fair pro-rata value of any unused Credits.
22.4 Effect of termination
On termination:
- Your license to use the Platform ends
- Your access to Organization Data ends after a 30-day grace period during which you can export data
- After the grace period, we will delete Organization Data in line with the Privacy Policy, except where the law requires us to keep it
- Any provisions of these Terms that by their nature should survive termination, including Sections 15, 16, 17, 18, 23, 24, 25, 26, and 27, will survive
23. Disclaimers
The Platform is provided "as is" and "as available". To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the Platform will be uninterrupted, error-free, or free of harmful components
- Warranties that any specific Assessment result, proctoring signal, or AI-generated output is accurate, complete, or fit for a particular hiring, education, or certification decision
- Warranties that the Platform will meet the specific requirements of any Organization or Candidate unless we have separately agreed those requirements in writing
Nothing in this Section 23 excludes any warranty or liability that cannot be excluded under applicable law.
24. Limitation of Liability
To the maximum extent permitted by applicable law:
- Neither party will be liable to the other for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profit, revenue, business, goodwill, data, or expected savings, whether or not the party was told the loss might happen
- Our total liability arising from or in connection with these Terms and your use of the Platform, whether in contract, tort (including negligence), or any other theory, is capped at the greater of (a) the amount you have paid to us in the 12 months immediately before the event giving rise to the claim, or (b) INR 25,000 (or the equivalent in your local currency)
- These caps and exclusions do not apply to (a) liability for death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any liability that cannot be limited or excluded by applicable law
25. Indemnification
You agree to defend, indemnify, and hold harmless TunnelQuiz and its directors, officers, employees, and agents from and against any claim, liability, cost, or expense (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your User Content
- Your use of the Platform
- Your violation of any law or of any third party's rights
TunnelQuiz will notify you of the claim, allow you to control the defense, and cooperate reasonably in the defense at your expense. You may not settle a claim in a way that admits liability on our part without our prior written consent.
26. Governing Law
These Terms are governed by, and construed in accordance with, the laws of India, without regard to conflict-of-law principles.
For customers based in the European Economic Area, the United Kingdom, or Switzerland, this choice of law does not deprive Candidates of the protection of any mandatory local consumer or data-protection law.
27. Dispute Resolution
We hope you never need this section, but if a dispute arises:
- Talk to us first. Before starting any formal proceedings, please contact us at [email protected]. We will try in good faith to resolve the dispute informally within 30 days.
- Jurisdiction. If informal resolution fails, the courts of Surat, Gujarat, India have exclusive jurisdiction over any dispute arising from or in connection with these Terms, subject to the mandatory laws of any consumer's jurisdiction.
- Arbitration option. Where both parties agree, disputes may be referred to binding arbitration under the rules of [the Arbitration and Conciliation Act, 1996 (India), or an equivalent recognized arbitral institution]. The seat of arbitration will be Surat, Gujarat, India and the language will be English.
- Injunctive relief. Nothing in this Section prevents either party from seeking urgent injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
28. Force Majeure
Neither party will be liable for delay or failure to perform any obligation under these Terms (other than payment obligations) to the extent that the delay or failure is caused by an event beyond that party's reasonable control, including, without limitation, natural disasters, pandemic or epidemic, acts of war or terrorism, civil unrest, government action, failure of the internet, or the failure of a third-party service on which the Platform depends.
The party affected by such an event will notify the other party as soon as reasonably practicable and will use reasonable efforts to mitigate the impact.
If a force majeure event continues for more than 90 consecutive days, either party may terminate the affected agreement by written notice, and TunnelQuiz will refund the fair pro-rata value of any unused Credits.
29. Changes to These Terms
We may update these Terms from time to time, for example, when we launch new features, when the law changes, or when we improve how we operate.
If a change is material, we will notify Organizations by email and post a prominent notice on the Platform at least 14 days before the change takes effect. Continued use of the Platform after the effective date means you accept the updated Terms.
If you do not accept a material change, you can stop using the Platform and, if you are an Organization within the first billing period after the change takes effect, request a pro-rata refund of any unused Credits.
Every version of these Terms is dated. Previous versions are available on request at [email protected].
30. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any Data Processing Agreement or order form that we have signed with you, are the entire agreement between us on their subject matter.
- Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets, on notice to you.
- Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- No agency. Nothing in these Terms creates any partnership, joint venture, agency, franchise, or employment relationship between the parties.
- Notices. We will give you notice at the email address on your account. You should give us notice at [email protected] or by written letter to the registered address in Section 31.
